1. Acceptance of Terms
By accessing or using the services provided by Bang Bang Leads, you agree to comply with and be bound by these Terms of Service. If you do not agree with these terms, please refrain from using our services.

2. Services Overview
Bang Bang Leads provides lead generation services to assist insurance agents in acquiring potential clients. Our services include but are not limited to the generation and provision of leads based on specified criteria.

3. Use of Services
You agree to use our services in compliance with all applicable laws and regulations. You shall not engage in any conduct that may impair or disrupt the functionality of our services or interfere with other users' ability to use our services. Leads are rendered on a 100% Exclusive basis for a particular purpose for which the consumer submitted the online form (“the specific vertical”), for instance, life insurance. You’re allowed to use the leads provided by us exclusively for your internal marketing purposes in the specific vertical to the consumers. You may not use the lead for purposes other than those that the consumer has expressly inquired about, or of third parties. Agents can’t redistribute or sell our leads.

4. Payment and Billing

4.1 Payment Terms: 
Payment terms for our lead generation services are outlined in the agreed-upon contract. Clients are responsible for the payment of services as specified in the contract.

4.2 Billing Information: 
You agree to provide accurate and up-to-date billing information. Failure to provide accurate billing information may result in a suspension of services.

4.3 Refund/Cancel Policy: 
We will cancel and refund your order in full within 2 hours of receiving your order. It is likely that we have already set up your campaign after this and began spending money. If you need to cancel your order, please email us at jaci@bangbangsocialmedia.com

5. Lead Quality
While we strive to provide high-quality leads, we do not guarantee the success or outcome of any business interactions resulting from the use of our services. Our commitment is to deliver leads that meet the criteria agreed upon, and we will work to address any concerns regarding lead quality promptly.

6. Lead Credit Policy: 
If a lead is more than 50 miles outside of your target zip, city or county, OR is outside of the age range of 50-85 years old, we will replace it.

7. Data Protection and Privacy
We are committed to protecting the privacy of your data. Our Privacy Policy outlines how we collect, use, and disclose information. By using our services, you consent to our privacy practices as described in the Privacy Policy.

8. Intellectual Property
All content and materials provided as part of our services are the intellectual property of Bang Bang Leads. You agree not to reproduce, distribute, or create derivative works from any content without our express permission.

9. Termination of Services
We reserve the right to terminate or suspend your access to our services at our discretion, without notice, for any reason, including but not limited to a violation of these terms.

10. Limitation of Liability
In no event will Bang Bang Leads, or its licensors or suppliers, be liable regarding any subject matter of this agreement under any contract, tort, negligence, liability or other legal or equitable theory for: (i) any incidental, special, or consequential damages; (ii) the cost of acquisition or substitute products or/and services; (iii) for the interruption of usage or loss or the corruption of data; or (iv) for any amounts that raise the fees paid by you to Bang Bang Leads be under this agreement during the twelve (12) month period prior to the date the cause of the action accrues. Bang Bang Leads shall have no form of liability for any failure or delay owing to matters beyond its reasonable control. The foregoing may not apply to the extent prohibited by relevant law.

11. Order Fulfillment
We do our absolute best to begin delivering leads between 24 – 72 hours, but because we are dependent on the advertising platform's approval of our campaign, it may take up to 10 days to deliver an order. However, in some cases, orders can experience slight delays owing to daily supply and demand market conditions on the Social media platforms we advertise on. In such a rare case, you will be notified and your leads will be delivered in a timely manner. There are a lot of factors that can impact the timeframe of order fulfillment. We reserve the right to start your order beyond the 48-72 hour mark or pause your campaign in order to keep up with other orders.

12. Opt-In and Opt-Out Terms
When you place an order with us, you are 'opting in' to receive SMS text messages and Emails with your lead's information by request. By placing an order, you agree to receive text message and emails from Bang Bang Leads. You will receive an email per every lead order placed with us. You may unsubscribe at any time by responding STOP to our texts and clicking the 'unsubscribe' like at the bottom of your emails.

13. Changes to Terms of Service
We may update these Terms of Service from time to time. Any changes will be posted on our website, and it is your responsibility to review these terms periodically.

Terms of Service - The Big Bang Weekly Subscription

1. Introduction
Welcome to Bang Bang Leads ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our lead generation services, including the weekly subscription plan that provides 50 Final Expense leads and access to a CRM for $250 per week (the "Service").
By subscribing to or using our Service, you ("Customer", "you", "your") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Subscription and Payment

2.1 Subscription Plan
The Service includes a weekly subscription plan providing 50 Final Expense leads and access to the Bang Bang CRM for $250 per week.

2.2 Payment
Payment for the Service is due in advance on a weekly basis. By subscribing to the Service, you authorize us to charge your provided payment method for the amount selected per week until you cancel the subscription.

2.3 Billing Cycle
The subscription fee will be billed at the beginning of your subscription and on a recurring weekly basis thereafter unless and until you cancel the subscription 48 hours in advance of the next payment date.

2.4 Changes to Fees
We reserve the right to change the subscription fee at any time. Any changes to the subscription fee will take effect at the beginning of the next billing cycle after we provide you with notice of the change.

2.5 CRM Messaging, Phone Number and Premium Action Fees & Charges
You agree to be billed by the CRM (GoHighLevel) to pay for any messaging including SMS, Emails, any premium actions. You also agree to pay for a phone number and the A2P 10DLC phone number application and fees involved.

2.6 Additional CRM Fees (Website Domain)
If you decide to move forward with getting a phone number set up in the CRM, you agree to be responsible for purchasing a domain and any fees to connect to the agent website template within the CRM.

3. Cancellation and Refunds

3.1 Cancellation
You may cancel your subscription 48 hours before you weekly next billing day by contacting us at jaci@bangbangsocialmedia.com. Cancellation will take effect at the end of the current billing period. You will not receive a refund for any partial weeks of the subscription. Any cancellations will result in loss of access to the CRM and other features included in the Big Bang weekly subscription.

3.2 Refunds
All fees and payments are non-refundable. We do not provide refunds or credits for any partial weeks of service, used or unused leads, or for any reason other than as required by applicable law.

4. Service Delivery

4.1 Lead Delivery
Leads will be delivered to you on a weekly basis via SMS, Email, (upon requested), a Google Sheet, and the Bang Bang CRM provided as part of the Service.

4.2 CRM Access
Access to the CRM is provided as part of your subscription. If you cancel or terminate your subscription, we hold the right to delete your CRM account and any leads that are attached to it. As well ask cancel access to the CRM. You are responsible for maintaining the confidentiality of your CRM login credentials and for all activities that occur under your account.

5. Use of Service

5.1 Permitted Use
You may use the Service for your internal business purposes only. You agree not to use the Service for any unlawful or prohibited purpose.

5.2 Prohibited Conduct
You agree not to (a) use the Service in any manner that could damage, disable, overburden, or impair the Service, (b) interfere with any other party's use of the Service, (c) attempt to gain unauthorized access to the Service or its related systems or networks, or (d) use any automated means to access the Service.

6. Intellectual Property

6.1 Ownership
We own all rights, title, and interest in and to the Service, including all related intellectual property rights. These Terms do not grant you any rights to our trademarks, service marks, or other intellectual property.

7. CRM Payments
We only bill you for the lead subscription. The CRM is a free additional tool we add on if you are interested in using it. You are responsible for any payments that come from the CRM including messaging funds, phone numbers, domains, premium actions, and any recurring payments. You are responsible to contact us and cancel your CRM account in order for the recurring payments to stop. Any of these payments previously mentioned that come from the CRM are non-refundable.

8. Limitation of Liability
To the maximum extent permitted by law, in no event shall Bang Bang Leads be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

9. Indemnification
You agree to indemnify, defend, and hold harmless Bang Bang Leads, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will provide notice of such changes, such as by sending an email, providing a notice through the Service, or updating the "Effective Date" at the top of these Terms. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the amended Terms.
